Purchase of the Scoreboard Message is subject to these terms and conditions, the rules, regulations, policies and procedures described herein, on cleguardians.com or otherwise communicated to purchasers (collectively, “Program Terms”). The supply of Scoreboard Messages is limited, and purchase of a Scoreboard Message may not be available or may sell out for your selected game. Scoreboard Messages may not include “Prohibited Language.” Prohibited Language includes references to MLB teams other than the Cleveland Guardians; inclusion of social media handles or other forms of promotional activity; or language deemed inappropriate or offensive for display, as determined in the sole discretion of the Cleveland Guardians. If a proposed Scoreboard Message includes Prohibited Language, the Cleveland Guardians may (but are not obligated to) contact the purchaser and provide the purchaser with the opportunity to amend the message to remove Prohibited Language. If the Cleveland Guardians ultimately refuse to post a purchaser’s Scoreboard Message, the Cleveland Guardians will either decline to charge the purchaser for the purchase of the Scoreboard Message(s) or refund to the purchaser the purchase price of the Scoreboard Message(s), less any applicable processing fees. Scoreboard Messages are purchased for display at a specific game on a specific date (the “Selected Game”). If the Selected Game is postponed or cancelled, the Scoreboard Message will not be displayed, and the Cleveland Guardians will refund to the purchaser the purchase price of the Scoreboard Message(s), less any applicable processing fees. If, following the purchase of a Scoreboard Message, the purchaser wishes to cancel such purchase, the purchaser may make a written request for a refund to
[email protected], including the name of the purchaser, the date the Scoreboard Message was to run, and the reason for cancellation (the “Refund Request”). The Cleveland Guardians have no obligation to honor or grant such Refund Request. If such Refund Request is granted, the Cleveland Guardians will refund to the purchaser the purchase price of the Scoreboard Message(s), less any applicable processing fees.
